If you're selling a used car privately, you should print off two copies of a buyer's/seller's contract - one for you, one for the buyer. This is essentially a receipt, proving you have sold a specific vehicle for an agreed price to a named person.

This contract should include the words 'sold as seen, tried and approved without guarantee'.

 

However, these words do not diminish the buyer's legal rights - namely that the vehicle was sold as described, and that, crucially, the car was roadworthy. It is illegal in the UK to sell an unroadworthy vehicle.

 

NOTE: The two copies of the car buyer's/seller's contract should be completed in the presence of both parties. Each should keep their copy safe.


What's included in a car buyer’s/seller’s contract?

It's also good to include an area for comments or notes about the vehicle/sale.

 

Next, the contract should include words to the effect of the following:

 

“The undersigned purchaser acknowledges receipt of the above vehicle in

exchange for the cash sum of £..........., this being the price agreed by the

purchaser with the vendor for the above named vehicle, receipt of which the

vendor hereby acknowledges. It is understood by the purchaser that the vehicle

is sold as seen, tried and approved without guarantee.”

What other documents are required when selling a used car privately?

  • The V5C (vehicle registration document), which must be sent to the DVLA. This is done by completing the new keeper details (section 6) and signing section 8. You must complete the new keeper part of V5C and give it to your buyer.
  • Car’s handbook, the service logbook and any receipts you have - for the buyer.
  • MOT certificate if the car is over three years old - for the buyer.
  • Buyers are also likely to appreciate any old MOT certificates and other maintenance receipts if you’re selling with a full-service history.
